1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and Kinase Life Inc governing your use of our Services. By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you don't agree, discontinue use immediately.
2. Eligibility & Account Requirements
You must be at least 18 years old to use our Services. By using our Services, you represent that you are 18+ and have legal capacity to enter this Agreement. When creating an account, you agree to provide accurate information, maintain account security, and accept responsibility for all account activities.
3. Service Scope & Limitations
Kinase Life Inc provides pet care education, wellness guidance, preventive care awareness, and marketing communications. Our Services include educational content, wellness tips, care reminders, and community resources for responsible pet ownership.
No Veterinary Services or Medical Advice
IMPORTANT: We do NOT provide veterinary services, medical diagnosis, treatment, or emergency care. Our Services are strictly educational and informational. We are not a substitute for professional veterinary care. You acknowledge that:
- All content is for general informational purposes only
- No veterinarian-client-patient relationship is created
- You must always consult a licensed veterinarian for medical concerns
- In emergencies, immediately contact a veterinarian or emergency clinic
- We are not liable for harm or loss from use or misuse of our Services
4. SMS Marketing Terms
Consent to Receive Messages
By providing your mobile number and checking the SMS consent box, you provide express written consent to receive recurring automated marketing text messages. This consent is voluntary and not required for purchasing goods or services.
TCPA Compliance
We comply with the Telephone Consumer Protection Act (TCPA) and all applicable laws governing SMS marketing. Your consent authorizes us to contact you via SMS using automatic dialing systems.
Message Details
- Frequency: 2-4 messages per month (may vary)

- Rates: Message and data rates apply from your carrier

Carrier Disclaimer
Mobile carriers are not liable for delayed or undelivered messages. Delivery depends on your wireless service provider. We're not responsible for transmission delays, network outages, or technical issues beyond our control.
5. User Conduct & Prohibited Activities
You agree not to:
- Violate any laws or regulations
- Infringe intellectual property rights
- Transmit harmful, threatening, or objectionable content
- Impersonate others or misrepresent affiliations
- Interfere with or disrupt the Services
- Attempt unauthorized access to systems or accounts
- Use automated systems (bots, scrapers) without permission
- Introduce viruses or malicious code
- Collect personal information about other users
6. Intellectual Property Rights
The Services and all content, features, trademarks, and materials are owned by Kinase Life Inc and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use our Services for personal, non-commercial use only. You may not reproduce, distribute, modify, or create derivative works without permission.
7. Payment Terms
Certain Services may require payment. All fees are in U.S. dollars and generally non-refundable unless specified. You agree to pay all applicable fees and authorize us to charge your payment method. Subscription services automatically renew unless canceled before renewal. We reserve the right to change fees with 30 days' advance notice.
8. Disclaimers & Limitations of Liability
THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR MEET YOUR EXPECTATIONS.
TO THE FULLEST EXTENT PERMITTED BY LAW, KINASE LIFE INC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR OTHER LOSSES, RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SERVICES, VETERINARY CARE DECISIONS BASED ON OUR SERVICES, OR HARM TO YOUR PET(S).
OUR AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF $100 OR AMOUNTS YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
9. Indemnification
You agree to defend, indemnify, and hold harmless Kinase Life Inc from claims, liabilities, damages, losses, and expenses arising from your violation of these Terms, misuse of Services, violation of third-party rights, or any harm to your pet(s) resulting from use of our Services.
10. Dispute Resolution
Before filing a legal claim, contact us at [info@kinaselife.site](mailto:info@kinaselife.site) to resolve disputes informally. Any dispute that cannot be resolved informally shall be resolved through binding arbitration administered by the American Arbitration Association in Amherst, Massachusetts.
Class Action Waiver: You agree that any proceeding shall be conducted individually and not as a class action. You waive the right to participate as a plaintiff or class member in any class action or representative proceeding.
11. Governing Law
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict of law provisions. Subject to arbitration provisions, you agree to the exclusive jurisdiction of courts in Hampshire County, Massachusetts.
12. Termination
You may terminate your account anytime by contacting [info@kinaselife.site](mailto:info@kinaselife.site). We may suspend or terminate your account immediately for violations of these Terms, fraudulent activity, or any other reason at our discretion. Upon termination, your right to use the Services ceases, and we may delete your account data.
13. Changes to Terms
We may modify these Terms at any time. Material changes will be communicated via email, SMS, or prominent notice on our Services. Continued use after changes constitutes acceptance. If you don't agree to modified Terms, discontinue use immediately.
14. General Provisions
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Kinase Life Inc. If any provision is invalid, the remaining provisions remain in effect. No waiver of any term constitutes a continuing waiver. You may not assign your rights without our consent. We may assign our rights without restriction.
